University indefinitely suspends Delta Sigma Phi

The Dean of Students office has suspended the Delta Sigma Phi fraternity indefinitely for alleged violations of the Student Code of Conduct. UNT spokesperson Kelley Reese said the fraternity is being investigated regarding the recently applied the Greek Life alcohol ban.

The ban was enacted on Feb. 7.

The alleged violation comes more than seven months after the end of a two-year probation that banned alcohol at the Delta Sigma Phi house. This is the first violation since the current ban was enacted.

“UNT is serious about taking the steps necessary to help stop the furnishing of alcohol to minors and the consumption of alcohol by minors,” Reese said.

According to a Denton County affidavit, Delta Sigma Phi member and business undeclared junior Guillermo Pujol allegedly provided alcohol to minors on Feb. 16. A UNT police officer witnessed the students unloading alcohol from an SUV.

The officer saw a student carrying two 30-packs of beer towards the fraternity house. The officer also found four liquor cases in the SUV.

The affidavit said that the 20-year-old Pujol told the officer that the alcohol was obtained elsewhere and the students were planning on having a party but it was later cancelled.

Delta Sigma Phi will not be able to take part in any meetings or programs, and loses all of its representation in the UNT community while the Dean of Students reviews the matter, according to a letter from Assistant Director for Dean of Students Brooke Everette.

Pujol was charged with purchasing and providing alcohol to minors on Feb. 19, a class A misdemeanor punishable by up to $4,000 and a year in jail after a warrant was issued the same day.

Pujol declined to comment. He is also a former Interfraternity Council member and he was released on $500 bond on Feb. 19.

Delta Sigma Phi was under Level II probation from June 2, 2010 until June 2, 2012 after police investigated a party that found minors were provided alcohol, drugs were present and the fraternity had provided false information to the Center for Student Rights and Responsibilities, according to Reese.

The fraternity is also being investigated in two other instances. The first incident allegedly happened on Feb. 16 for failing to comply with an officer. The second incident occurred on Jan. 26 when alcohol was allegedly provided to minors.

The alcohol allegation led to the alcohol ban after Dustin Starks, an accounting junior and a member of Sigma Nu, fell over a stairway and was hospitalized. Seven arrests were made for furnishing alcohol to minors.

A Notice of Complaint released on Feb. 25 said all three incidents require immediate attention through meeting with the Dean of Students and the Delta Sigma Phi fraternity.

McGuiness, and the UNT Police Department referred the NT Daily to Reese.

“The university takes this issue seriously,” Reese said. “Furnishing alcohol to a minor and the consumption of alcohol by a minor is illegal. UNT will not tolerate either and takes action when we are aware of any issue involving our student body.”
